Welcome to Roofer Pricing, a lead generation platform that collects customer information via an instant estimator tool (“Services”) and provides these leads to roofing professionals (“Clients”). By using the Services, you agree to these Terms of Use (the “Terms”). If you do not agree with these Terms, you may not access or use the Services.

For Clients:

• Roofer Pricing does not guarantee the quality, accuracy, or conversion potential of leads.
• Clients must use the leads solely for providing roofing services and must not resell or share them without written permission.

For Customers:

• By using the estimator, you agree that your information may be shared with roofing professionals who may contact you regarding their services.
• Estimates provided through the tool are approximate and should not be considered final.

5. Payments and Fees

Clients are required to pay for leads as per their agreement with Roofer Pricing:

• Payments must be made in accordance with the terms provided during purchase.
• All sales are final; refunds will only be issued at Roofer Pricing’s sole discretion.
• Roofer Pricing reserves the right to suspend or terminate access to Services for non-payment.

6. Use of the Services

You agree to use the Services only for lawful purposes and in compliance with these Terms:

1. You must not misrepresent yourself or your intentions when using the Services.
2. Clients must use the leads exclusively for their roofing business.
3. Any misuse, including unsolicited marketing or reselling of leads, is prohibited.
4. You may not copy, modify, reverse engineer, or distribute any part of the Services.

7. Disclaimer of Warranties

The Services and any information provided, including leads and estimates, are offered “as-is” and without warranties of any kind.

• Roofer Pricing does not guarantee the accuracy, completeness, or reliability of any data or estimates.
• We disclaim all implied warranties, including fitness for a particular purpose, merchantability, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law:

• Roofer Pricing is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.
• Total liability under these Terms shall not exceed the total amount paid by the Client in the 12 months preceding the claim or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Roofer Pricing, its affiliates, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from:

1. Your use of the Services.
2. Your violation of these Terms.
3. Any disputes with customers or other third parties.

10. Intellectual Property

Roofer Pricing owns all rights, title, and interest in the Services, including the instant estimator tool, trademarks, and proprietary content.

• You may not use, reproduce, or distribute any content from the Services without prior written permission.

11. Dispute Resolution

All disputes arising under these Terms will be resolved as follows:

1. Arbitration: Any disputes will be resolved through binding arbitration conducted under JAMS Streamlined Arbitration Rules.
2. Class Action Waiver: Claims must be brought on an individual basis, and class actions are prohibited.
3. Governing Law: These Terms are governed by the laws of the State of California.

12. Termination of Services

Roofer Pricing may terminate or suspend your access to the Services at any time for violations of these Terms. Upon termination:

• Clients must cease use of any leads obtained through the Services.
• Any obligations that survive termination, including indemnification and limitations of liability, will remain in effect.

13. Lead Quality Disclaimer

While we strive to ensure leads are relevant and accurate:

• Roofer Pricing does not guarantee the validity of customer-provided information.
• Clients are responsible for verifying leads before providing services.

14. Customer Disputes

Roofer Pricing is not involved in the relationship between Clients and customers. Clients are solely responsible for resolving any disputes with customers.
